It was discovered that two cooling towers were operating for the last eight months without any management systems in place for the control of legionella. The inspectors immediately asked that the two towers be shut down and directed the company to take the necessary steps to rectify the issue.

The company was aware of the seriousness of the issues especially since there had been many outbreaks of legionella in the last few years. It had also been warned by a water inspector that a management system was required to be installed in the towers, but chose to ignore his advice. It had received quotations from two water treatment companies for the systems but failed to get any system installed. The company had also failed to monitor or perform the required tests on the towers to certify if they were in usable condition. All these failings showed total disregard for the employees’ safety and health on the part of the company’s Managing Director, Ernest Jones.

Dudley magistrates who heard the case were informed by Sarah Palfreyman, HSE inspector, that the company was aware of its legally bound duties but chose to avoid performing them. She said that in spite of receiving all the information and knowing that legionella existed in high quantities in the two cooling towers, the company did not take any measures to control the bacteria. She added that the risk was predictable and could have been avoided, and therefore, Mr. Jones, who heads the company, should be held accountable for his negligent behaviour.
